Business & Investor Visas (Various Subclasses)

This category is for business owners, entrepreneurs, and investors who want to establish a business or invest in Australia. Many of the previous key visas (Subclass 188 and Subclass 132) are currently closed or have been significantly restructured/closed for new applications as of late 2025/mid-2024 (e.g., the Business Innovation and Investment Program (BIIP) is closed for new 188 applications). Future programs, such as the National Innovation Visa, are being developed.

Note: Due to significant and recent changes/closures to the key Business and Investor Visa program (BIIP), details are constantly evolving. Always check the Department of Home Affairs website for the latest status.

Visa Application Whole Process (General/Legacy Process)

  1. Expression of Interest (EOI): Submit an EOI in SkillSelect.

  2. State/Territory Nomination: You must receive a nomination from a State or Territory government.

  3. Invitation to Apply (ITA): If nominated, you are invited to apply for the provisional visa (e.g., former Subclass 188).

  4. Provisional Visa: Once granted, you live in Australia and meet the business/investment criteria over the provisional visa period (e.g., 5 years).

  5. Permanent Visa: Once the criteria are met, you apply for the permanent visa (e.g., former Subclass 888).

Where and How to Apply for Visa?

  • Where: The EOI is lodged via SkillSelect. The visa application is then lodged via ImmiAccount.

  • How: This is a highly complex process requiring careful adherence to nomination and investment requirements. It is strongly recommended to engage a Registered Migration Agent or financial advisor specialising in these visas.

Necessary Documents (Key Examples)

  • Financial Documents: Evidence of net business and personal assets (at least AUD 2.5 million was required for certain streams), business turnover, and successful business/investment management history.

  • Complying Investment Evidence: Proof of investment in approved venture capital, managed funds, and balancing investments (for the Significant Investor stream, this was AUD 5 million).

  • Nomination Approval: Letter of nomination from the State/Territory government.

  • Business Plan: Detailed plan outlining proposed business activities in Australia.

Visa Question Related to Immigration Process

No, the BIIP (including the Subclass 188 provisional visa) has been closed to new applications as of late 2025/mid-2024. Pathways remain for existing provisional visa holders to transition to permanent residency.

These were specific types of investments required for the Significant Investor stream, structured across venture capital, emerging companies funds, and balancing investments. Direct investment in residential real estate is prohibited.

For some streams (like the former Significant Investor), there was no age limit. For others (like Business Innovation), an age limit (often under 55) or a waiver through nomination was required.
